1. Acceptance of Terms

By accessing or using our services, you agree to be bound by these Terms of Service ("ToS"), our Privacy Policy, and our Fair Use Policy. If you do not agree to all of these terms, do not use our services. Your continued use of the service constitutes acceptance of these terms.

2. Age Requirement and Account Eligibility

You must be at least 13 years of age to use our service. If you are between the ages of 13 and 18 (or the age of legal majority in your jurisdiction), you must have the permission of your parent or legal guardian to use the service and make purchases. By using the service, you represent and warrant that you meet these requirements. Parents or legal guardians are responsible for supervising minors' use of the service and any purchases made. Payment methods (credit cards, bank accounts) are typically restricted to adults, providing a natural verification mechanism.

3. Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately if you discover unauthorized use of your account. We are not liable for losses or damages arising from the unauthorized use of your account.

4. Prohibited Activities

You are strictly prohibited from using our services for any of the following activities:

• Illegal Content: Hosting, distributing, or linking to any illegal content, including but not limited to pirated software, copyrighted material without permission, child exploitation material, or content that promotes harassment or violence.
• Cryptocurrency Mining: Cryptocurrency mining or any related activities, including proof-of-work computations for blockchain networks.
• Malicious Attacks: Launching malicious attacks, including but not limited to DDoS attacks (Layer 4 and Layer 7), port scanning, SSH brute-force attempts, hosting malware, phishing websites, botnets, or command and control servers.
• Resource Abuse: Engaging in resource abuse, such as running programs designed to intentionally cause extreme CPU, memory, or network load for purposes other than the intended use of a game server. This includes intentional disk-filling scripts.
• Leaked/Cracked Software: Using leaked, cracked, backdoored, or pirated plugins, setups, or software. Any software obtained from unofficial or "leaked" sources is strictly prohibited.
• Unauthorized Sharing: Reselling, sharing, subletting, or otherwise distributing your service to third parties without our explicit written permission.
• Proxy/VPN Services: Operating public proxies, VPNs, or similar services that redirect traffic through your server.
• Web Scraping: Performing unauthorized web scraping, data crawling, or automated data collection.
• Spam/Abuse: Using our services to send spam, engage in phishing, or participate in abusive or harassing activities.
• TOS Violations: Any violation of Discord's, Pterodactyl's, or other third-party service providers' terms of service.

5. Server Management and Resource Allocation

Our service provides you with allocated server resources including CPU, memory, disk space, and network bandwidth based on your plan. These allocations are intended for legitimate game server hosting only. Exceeding resource limits or attempting to circumvent resource enforcement mechanisms is prohibited. We reserve the right to throttle, suspend, or terminate services that violate these terms.

6. Consequences of Violation

Violation of these terms will result in immediate action, which may include:

• Immediate suspension of the offending server without prior notice.
• Termination of your entire account.
• Permanent ban from our services.
• Forfeiture of all remaining account balance and prepaid credits.

No refunds will be issued for accounts or services terminated due to a violation of these terms. If your account is suspended, you may request a copy of your server data and configurations within seven (7) days of the suspension date. After this period, we are not obligated to provide your data, and deletion will proceed. Repeated violations may result in a permanent account ban.

7. Payment Terms

By making a purchase on our platform, you agree to the following payment terms:

• All prices are displayed in your selected currency and include applicable taxes.
• Payment is processed immediately upon purchase through Stripe.
• You are responsible for ensuring your payment method has sufficient funds.
• We reserve the right to decline or cancel transactions that appear fraudulent or suspicious.
• Refunds for legitimate service disruptions are issued at our discretion.
• By clicking "Register" or "Pay," you expressly consent to the immediate performance of the service. You acknowledge that by gaining immediate access to the hosting control panel, you lose your right of withdrawal (atteikuma tiesības) regarding this purchase.

8. Service Availability and Limitations

While we strive to maintain 24/7 uptime, we do not guarantee uninterrupted service. We reserve the right to:

• Perform maintenance or updates that may temporarily affect service availability.
• Suspend or terminate services for security, compliance, or policy violations.
• Modify, reduce, or upgrade service features or resource allocations.
• Rate limit or throttle usage to ensure fair resource distribution among users.

We are not liable for damages resulting from service interruptions, data loss, or server failures unless caused by our gross negligence.

9. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, even if we have been advised of the possibility of such damages.

10. Indemnification

You agree to indemnify, defend, and hold harmless us, our officers, directors, employees, and agents from any claims, damages, losses, or liabilities arising from your use of our services, violation of these terms, or infringement of any third-party rights.

11. Modifications to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes by updating the date on this page and posting the new terms. Your continued use of the service after any such changes constitutes your acceptance of the new terms. We recommend reviewing these terms periodically.

12. Suspension and Account Termination

We reserve the right to suspend or terminate your account at any time for:

• Violation of these terms
• Suspicious or fraudulent activity
• Non-payment of outstanding invoices
• Requests from law enforcement
• Any other reason we deem necessary for safety or compliance

13. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Republic of Latvia. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Latvia.

14. Entire Agreement

These Terms of Service, together with our Privacy Policy and Fair Use Policy, constitute the entire agreement between you and us regarding your use of our services and supersede all prior agreements and understandings.
